The National Privacy Principles

The Australian Government introduced legislation (Commonwealth Privacy Act 1998) that came into force on 21 December 2001 to protect the privacy of individuals. This legislation comprises ten National Privacy Principles that apply to private sector organisations. You can find out more about these principles by calling the Office of the Privacy Commissioner on 1300 363 992 or by consulting their website at www.privacy.gov.au.

The project partners of www.OxyGen.org.au respect and uphold your rights to privacy protection under the National Privacy Principles by regulating the way in which we collect, use, disclose, hold and destroy your personal information. Each of the project partner organisations has a detailed policy and set of procedures to ensure that only staff has access to your personal information and that it remains confidential and only used for appropriate purposes and in accordance with their policy.

Quit Victoria, Quit South Australia and the Smarter than Smoking Project (based at the National Heart Foundation, WA Division) have created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our dissemination practices and information gathering for www.OxyGen.org.au.

This site contains links to other sites. OxyGen is not responsible for the privacy practices or the content of those Web sites.

The OxyGen management group deems all the material on the OxyGen site as relevant and appropriate to the website's target audience however, we recommend educators view material prior to use with young people.

Why we collect your personal information

On the OxyGen site, we collect personal information when:

• a user has filled in the on-line order resource form;
• a user interacts with our site via forwarding a question, providing feedback, posting a story, video etc;
• a user subscribes to our O-News or OxyGen ebulletin and/or
• a user enters one of our competitions and provides us with their contact details.

We collect each visitor's contact information (e.g. their e-mail address) when users make contact with us, whether this is through them forwarding a question, placing an order, providing feedback, posting a story or similar. Users may opt-out of receiving future mailings; see the ‘Choice/Opt-Out’ section below. We will not provide any personal contact information to any other organisation or individual without the user's expressed consent. Any personal information that we collect about you will only be used by us for the reason it was collected in the first instance. We do not sell, lend or give away any information collected from any of our activities. All hard copy data is disposed of appropriately when no longer required.

Like most websites, we track usage patterns on our website for evaluation purposes. Specifically, we record:

• Internet providers
• Date and time of visits
• Pages accessed and documents downloaded.

Although we do collect statistics when you visit our site, they only record how often a page is visited. In other words, this information does not contain any means by which we can identify you, it merely records a tally of visitors.

Sometimes we need to store temporary information, which can personalise your visit to our site, using cookies. Cookies is simply an alternative for storing information used by web page scripts in your computer's browser rather than on a server. Cookies cannot gather any more information about you than what is already publicly available when you surf the web or what you offer in a web form.

We will only record your email address if you contact us. Your email address will not be used for any other purpose without your consent. (Note: Legal obligations to disclose personal information may override the provisions of privacy legislation)

The OxyGen website contains links to other sites of interest. OxyGen does not control, and is not responsible for, the content or privacy practices of those websites. Please check the Privacy Statements on other websites before you provide your personal information to them.

By using the OxyGen website, you agree that the Internet is inherently insecure and accordingly, OxyGen partner organisations cannot provide any definite assurance regarding security or personal information. The Cancer Council Victoria, The Cancer Council South Australia and the National Heart Foundation (WA Division) will not be liable in any way in relation to any breach of security or any unintended loss or disclosure of that information.

Security

This site has security measures in place to protect the loss, misuse and alteration of the information under our control. All information is stored on a computer, which is password protected and is only accessible to the OxyGen management group.

Spam e-mail

The OxyGen site does not use e-mail address harvesting software. Sending of email to multiple external email addresses must conform with the Spam Act 2003 where:

• Consent must be given by the recipient to receive commercial emails;
• The mail addresses must not have been harvested using email address harvesting software;
• The mails must clearly specify the sender and the sender must be contactable for a period of three months after the recipient has received the email;
• The emails must provide a means allowing the receiver to un-subscribe from receiving any future similar email message.

Changes to our Privacy Policy

The OxyGen management board may, without notice, amend or modify its Privacy Policy by posting the amended Privacy Policy on this website.

Choice/Opt-Out

The site gives visitors the option to opt-out and remove their information from our database to stop all future direct communications from us. If you would like your listed details to be removed from the site please contact us.

Confidentiality

Only the OxyGen management board has access to the information provided in the course of their duties. They respect its confidentiality and do not disclose it to any third party unless required to for the sale and delivery of resources ordered on the site.

Breaches of confidentiality attract severe penalties through the Privacy Policies of the partner organisations.
